Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you (whether personally or on behalf of an entity) and LankaDerana.lk ("LankaDerana", "we", "us", or "our"), regarding your access to and use of our website, classifieds listing engine, user dashboard, and related services (collectively, the "Platform").

By accessing, browsing, registering for an account, or publishing advertisements on LankaDerana.lk, you agree that you have read, understood, and accept to be bound by all of these Terms. If you do not agree with all of these Terms, you are explicitly prohibited from using the Platform and must discontinue use immediately.

Nature of the LankaDerana Marketplace

LankaDerana operates exclusively as an online communications and classifieds directory facilitating connections between independent sellers, buyers, renters, landlords, and service providers across Sri Lanka:

  • No Ownership or Possession: LankaDerana does not manufacture, own, inspect, hold in custody, or sell any item or service advertised by users on the Platform.
  • Independent Contracting: All commercial contracts, negotiations, payments, and handovers occur directly between the buyer and seller. LankaDerana is not a party to any transaction and does not act as an escrow agent, broker, or guarantor.
  • Listing Accuracy: While we enforce strict ad moderation guidelines, sellers bear sole legal and factual responsibility for the descriptions, pricing, legality, and condition of items they advertise.

User Eligibility & Account Obligations

To access certain features, including posting advertisements and managing saved favorites, you may be required to register for an account. By registering, you warrant that:

  • You are at least 18 years of age or possess legal parental/guardian consent to enter into binding agreements.
  • All registration information you submit (including full name, valid email address, and active telephone number) is accurate, truthful, and current.
  • You are responsible for maintaining the confidentiality of your account credentials and are entirely responsible for all activities that occur under your account.
  • You will not create accounts using false identities, disposable emails, or impersonate any other individual or business entity.

Rules for Posting Advertisements

To ensure quality and trust for all users, every listing posted on LankaDerana must comply with our editorial standards:

What You Must Do:
  • Categorize your listing under the correct category and accurate Sri Lankan district/city.
  • Provide genuine, clear photographs of the actual item being sold.
  • State transparent pricing in Sri Lankan Rupees (LKR) without hidden deceptive fees.
  • Mark your ad as "Sold" or remove it once the transaction is completed.
What You Must Not Do:
  • Post duplicate listings of the same item within the same or multiple categories.
  • Use stock images, copyrighted watermarked photography, or misleading visual renderings.
  • Include misleading keyword spamming or inaccurate vehicle odometer / property measurements.
  • Post promotional advertisements directing users to phishing or deceptive websites.

Strictly Prohibited Goods & Content

In accordance with the Laws of Sri Lanka and global digital advertising safety standards (including Google AdSense Publisher Policies), the following goods, services, and content are strictly forbidden on LankaDerana:

  • Firearms, ammunition, weapons, fireworks, or explosives.
  • Narcotics, illegal drugs, prescription medications, or medical equipment.
  • Counterfeit items, replica brand goods, and forged identification documents.
  • Adult, sexually suggestive, escort, or pornographic content.
  • Protected wildlife, ivory, or items regulated under the Flora & Fauna Protection Ordinance.
  • Pyramid schemes, multi-level marketing (MLM), or quick-cash schemes.
  • Stolen property or vehicles without clear lawful registration.
  • Hate speech, defamation, harassment, or unlawful political propaganda.
Violation of these prohibitions will result in immediate listing deletion, account termination, and potential reporting to Sri Lankan law enforcement authorities.

Third-Party Advertisements & Google AdSense

LankaDerana displays third-party advertisements, promotional banners, and sponsored units provided by advertising networks, including Google AdSense:

  • Third-party advertisers operate independently and are not controlled by LankaDerana. Display of an advertisement does not constitute an endorsement or warranty of the advertised product or service.
  • Google AdSense uses cookies to deliver contextual and interest-based ads. Your interaction with third-party advertisements is governed by the respective advertiser's terms and privacy policy.
  • Users agree not to engage in fraudulent clicks, automated bots, or artificially inflate advertisement impressions on our website.

Safety & Safe Trading Guidelines

While we take active security steps, your personal safety during face-to-face transactions is essential. We strongly urge all buyers and sellers to follow these practices:

Meet in Daylight

Always conduct meetings in busy, well-lit, public locations (e.g. banks, shopping malls, police stations).

Never Advance Pay

Do not transfer advance deposits or courier fees before physically seeing and verifying the goods.

Verify Ownership

Verify vehicle CR books, deed titles, national identity cards, and receipts before parting with money.

Intellectual Property Rights

All platform software, graphics, user interface designs, trademarks, logos, and proprietary features belong exclusively to LankaDerana.lk. Users are granted a limited, non-exclusive license to access and browse the website for individual, non-commercial purposes.

When you upload content, photographs, or text to LankaDerana, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, display, reproduce, and distribute the content solely in connection with operating and promoting the Platform.

Moderation & Termination

LankaDerana reserves the absolute right, without prior notice or liability, to reject, modify, reposition, unpublish, or delete any listing, or suspend/terminate user accounts that violate these Terms, infringe upon third-party rights, or compromise the safety and integrity of the marketplace.

Disclaimer of Warranties & Limitation of Liability

LankaDerana is provided on an "AS IS" and "AS AVAILABLE" basis. We make no express or implied representations or warranties regarding the accuracy, completeness, reliability, or availability of any listing or content.

To the maximum extent permitted by applicable law, LankaDerana, its directors, officers, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or interactions with other users.

Governing Law & Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or related to your use of LankaDerana.lk shall be governed by and construed in accordance with the Laws of the Democratic Socialist Republic of Sri Lanka. The courts located in Colombo, Sri Lanka shall have exclusive jurisdiction to settle any disputes.
